Terms and conditions of use

Article 1: Purpose

The purpose of these general terms and conditions of use (hereinafter the "T&Cs") is to define the conditions of use of the Website.

Consultation of the Website by any user (hereinafter "the User") implies acceptance of the T&Cs.

It is expressly agreed that any provision contrary to those contained in the T&Cs shall be deemed unwritten, and that should any clause be declared null and void or ineffective, the validity of the remaining clauses shall not be affected.

The T&Cs may be amended from time to time, and it is the user's responsibility to consult the latest version of the said conditions each time he visits the Website.

Article 2 : Access to the Website

Access to the Website is free of charge.

The Website is accessible 24 hours a day, 7 days a week, except in the case of force majeure, fortuitous event or act of a third party, such as those usually recognized and defined by the jurisprudence of French courts.

Likewise, in exceptional cases, the User is informed that the operation of the Website may be temporarily suspended to allow IMMERSION and its service providers to carry out maintenance and/or technical operations.

The User will not be able to claim any prejudice to IMMERSION in case of inaccessibility of the Website.

IMMERSION reserves the right to refuse at any time access to the Website to any User in the event of non-respect by the latter of the T&Cs, infringement of IMMERSION's rights (in particular intellectual property rights) or the rights of third parties.

Article 3 : Responsibility of the User

The User undertakes to respect the present T&Cs.

Any violation and/or any unauthorized use of the Website or its contents by the User could give place to the granting of damages and/or any other sanction within the framework of legal actions, in particular in the event of violation by the User of intellectual property rights and rights to the image of IMMERSION or third parties.

Article 4 : Responsibility of IMMERSION

IMMERSION makes every effort to ensure that the information contained on the Website is as accurate as possible.

In the hypothesis where the Website would contain inaccuracies, omissions, errors or would be the object of dysfunctions, the User is invited to inform IMMERSION.

The User is informed that he will not be able to claim any damage to IMMERSION in case of defect and/or dysfunction of the Website.

Any content downloaded from the Website is done at the User's risk and under his sole responsibility.

Therefore, IMMERSION cannot be held responsible for any damage suffered by the User or for any loss of data resulting from such downloading.

It is specified that the photographs on the Website are provided for information only and have no contractual value.

Furthermore, IMMERSION declines all responsibility in particular in the following cases:

  • malfunctioning of the User's infrastructure (hardware, software, operating system, etc.)

  • service interruption due to maintenance operations or technical incidents

  • usurpation of the User's identity

In general, IMMERSION cannot be held responsible for the consequences of the User's violation of these T&Cs.

Insofar as no control is exercised over these external resources, the user recognizes that IMMERSION assumes no responsibility relative to the provision of these resources, and cannot be held responsible for their content.

Article 6: Cookies

The Website contains different types of cookies:

Article 7: Personal data

Personal data refers to any information concerning an identified or identifiable natural person.

7.1 Data collected

The personal information collected via the Website is confidential and is intended to be processed mainly in order to respond to requests for information made by the User and/or to process his order, and to improve the operation of the Website.

This processing is based on IMMERSION's legitimate interests, notably in the context of the execution of pre-contractual or contractual measures and in order to comply with applicable regulations and legislation.

The personal data that may be collected via the Website are as follows:

Data collected through cookies, including IP address and unique identifier of the User's device

When IMMERSION no longer needs to use the User's personal data, they are deleted from its systems and registers or rendered anonymous in order to no longer allow the identification of the User, subject to conservation for archival purposes, management of complaints and disputes as well as to satisfy legal and/or regulatory obligations incumbent upon IMMERSION, or to respond to requests from authorities authorized to make such requests.

IMMERSION is committed not to make a use contrary to the legislation in force as regards personal data.

7.2 Retention period

Personal data collected from any User will be deleted by IMMERSION after a period of three years of inactivity (except in case of need to comply with its legal and regulatory obligations).

As an exception, personal data collected via cookies and tracers are kept for a maximum period of twenty-five months from the date of collection.

7.3 Persons authorized to access personal data

The personal data collected are intended for IMMERSION and, if necessary, its technical service providers.
IMMERSION undertakes that only duly authorized persons may access the personal data collected when this is necessary for the aforementioned purposes.

IMMERSION will not communicate the personal data collected to third parties for commercial purposes.

IMMERSION will only communicate this information if necessary, and if possible in a form that does not allow direct identification.

7.4 Protection of data confidentiality

IMMERSION takes all necessary precautions to guarantee the confidentiality and security of data collected via the Website, and to prevent them from being deformed, damaged, destroyed or accessed by unauthorized third parties.

However, IMMERSION cannot be held responsible in the event of interception of said data by unauthorized third parties.

  • Right of rectification: the User has the right to have his personal data rectified if they are inaccurate or obsolete and / or to complete them if they are incomplete;
  • Right to erasure / right to be forgotten: the User has the right to have his or her data erased or deleted. However, this right may be limited by a legal reason or by IMMERSION's legitimate interest in keeping personal data;
  • Right of opposition: the User may at any time refuse to allow his personal data to be used;
  • Right to withdraw consent at any time for data processing based on consent: the User may withdraw his consent to the processing of his data when such processing is based on consent;
  • Right to data portability: the User has the right to move, copy or transfer data from the IMMERSION database to another. This right applies only to data provided by the User, and provided that the processing is based on a contract or the User's consent and carried out using automated processes.

The User may exercise the rights described above by contacting IMMERSION in the manner provided below.

The User also has the right to formulate specific or general directives concerning the conservation, deletion and communication of his post-mortem data.

However, it is recommended that the User first contact IMMERSION before filing a complaint with the CNIL insofar as IMMERSION remains at the entire disposal of the User to settle any possible disputes.

Article 8 : Intellectual property

Immersion is the owner of the intellectual property rights or holds the rights of use on all the elements accessible on the Website, in particular the trademarks, drawings, models, texts, images, illustrations, photographs, graphics, logos, icons, sounds, videos, software, graphic charter.

Any reproduction, representation, modification, publication, adaptation of all or part of the elements of the Website, whatever the means or process used, is forbidden, except with the prior written authorization of Immersion.

Any unauthorized use of the Website or of any of the elements it contains will be considered as constituting an infringement and will be prosecuted in accordance with the provisions of articles L.335-2 et seq. of the French Intellectual Property Code.

Article 9 : Disputes

Any dispute relating to the application and/or interpretation of the T&Cs shall be governed by French law.

Priority must be given to an attempt at amicable settlement.

In the event of a dispute with a professional, the action must be brought before the competent courts within the jurisdiction of the Bordeaux Court of Appeal. In the event of a dispute with a consumer, the rules of territorial competence and jurisdiction apply.
